I first seriously contemplated writing a book on degree theory in 1976 while I was visiting the University of Illinois at Chicago Circle. There was, at that time, some interest in ann-series book about degree theory, and through the encouragement of Bob Soare, I decided to make a proposal to write such a book. Degree theory had, at that time, matured to the point where the local structure results which had been the mainstay of the earlier papers in the area (...) were finding a steadily increasing number of applications to global degree theory. Michael Yates was the first to realize that the time had come for a systematic study of the interaction between local and global degree theory, and his papers had a considerable influence on the content of this book. During the time that the book was being written and rewritten, there was an explosion in the number of global theorems about the degrees which were proved as applications of local theorems. The global results, in turn, pointed the way to new local theorems which were needed in order to make further progress. I have tried to update the book continuously, in order to be able to present some of the more recent results. It is my hope to introduce the reader to some of the fascinat ing combinatorial methods of Recursion Theory while simultaneously showing how to use these methods to prove some beautiful global theorems about the degrees. The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. Philosophers disagree whether composition as identity entails mereological universalism. Bricker :264–294, 2016) has recently considered an argument which concludes that composition as identity supports universalism. The key step in this argument is the thesis that any objects are identical to some object, which Bricker justifies with the principle of the universality of identity. I will spell out this principle in more detail and argue that it has an unexpected consequence. If the universality of identity holds, then composition as identity not (...) only leads us to universalism, but also leads to the view that there are no mereological atoms. (shrink)

The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

The E.U. is shortly before implementing the Digital Markets Act (DMA), which aims to regulate digital markets and (ideally) rein in the power of big tech gatekeepers. Several researchers claim that this proposal – and especially its goal to ensure the contestability and fairness of digital markets – is ordoliberal in nature, yet what is missing in the academic literature is a closer look at the parallels (and differences) between the E.U.’s competition policy (and the DMA) and ordoliberalism. This paper (...) tries to close the gap and help answer the question of whether the DMA is indeed standing in an ordoliberal tradition. Furthermore, it evaluates the Act’s institutional strengths and weaknesses – as seen from an ordoliberal perspective – and points out potential ways to strengthen E.U. competition policy (and the DMA) and bring it closer to the ordoliberal ideal. Composition as Identity is the view that an object is identical to its parts taken collectively. I elaborate and defend a theory based on this idea: composition is a kind of identity. Since this claim is best presented within a plural logic, I develop a formal system of plural logic. The principles of this system differ from the standard views on plural logic because one of my central claims is that identity is a relation which comes in a variety of (...) forms and only one of them obeys substitution unrestrictedly. I justify this departure from orthodoxy by showing some problems which result from attempts to avoid inconsistencies within plural logic by means of postulating other non-singular terms besides plural terms. Thereby, some of the main criticisms raised against Composition as Identity can be addressed. Further, I argue that the way objects are arranged is relevant with respect to the question which object they compose, i.e. to which object they are identical to. This helps to meet a second group of arguments against Composition as Identity. These arguments aim to show that identifying composite objects on the basis of the identity of their parts entails, contrary to our common sense view, that rearranging the parts of a composite object does not leave us with a different object. Moreover, it allows us to carve out the intensional aspects of Composition as Identity and to defend mereological universalism, the claim that any objects compose some object. Much of the pressure put on the latter view can be avoided by distinguishing the question whether some objects compose an object from the question what object they compose. Eventually, I conclude that Composition as Identity is a coherent and plausible position, as long as we take identity to be a more complex relation than commonly assumed. (shrink)

In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. The emphasis of systems and synthetic biology on quantitative understanding of biological objects and their eventual re-design has raised the question of whether description and construction standards that are commonplace in electric and mechanical engineering are applicable to live systems. The tuning of genetic devices to deliver a given activity is generally context-dependent, thereby undermining the re-usability of parts, and predictability of function, necessary for manufacturing new biological objects. Tolerance and allowance are key aspects of standardization that need to be (...) brought to biological design. These should endow functional building blocks with a pre-specified level of confidence for bespoke biosystems engineering. However, in the absence of more fundamental knowledge, fine-tuning necessarily relies on evolutionary/combinatorial gravitation toward a fixed objective. (shrink)

This article examines Nietzsche’s analysis of the phenomenology of agent causation. Sense of agent causation, our sense of self-efficacy, is tenacious because it originates, according to Nietzsche’s hypothesis, in the embodied and situated experience of effort in overcoming resistances. It arises at the level of the organism and is sustained by higher-order cognitive functions. Based on this hypothesis, Nietzsche regards the sense of self as emerging from a homeostatic system of drives and affects that unify such as to maintain self-efficacy (...) levels. He relies on the same hypothesis to explain the emergence of an ascetic moral system and its specific, interpretive-affective ‘mechanism of willing’. The article aligns Nietzsche’s account of agent causation with Albert Bandura’s self-efficacy studies and Antonio Damasio’s recent account of self-systems as homeostatic systems. (shrink)

L’article présente une explication de ce liage sans identité apparente. Une objection est adressée à la théorie des proxies de Reuland et Winter, fondée sur la distinction entre attitudes de re et attitudes de se. La stratégie proposée ici consiste à introduire une nouvelle modalité pour chaque nouveau support d’une représentation physique, ce qui permet d’éviter les proxies (...) et de restaurer l’identité à la base de la résolution des anaphores. Les modalités correspondent à des fenêtres modales au travers desquelles le sujet peut appréhender des objets, existants ou non, y compris lui-même. La sémantique proposée suppose de réinterpréter certains prédicats. Elle emprunte à Wehmeier l’idée de relation inter-mondaine, qui soulève en tant que telle des questions métaphysiques. L’article aborde ces questions, pour proposer finalement d’étendre la théorie des fenêtres modales à l’ensemble des relations intentionnelles. (shrink)

In this work we provide a new topological representation for implication algebras in such a way that its one-point compactification is the topological space given in [1]. Some applications are given thereof.

Our democracies presently face a set of unique challenges. In this article we argue that the current crisis needs to be understood as resulting from the convergence of two historical transformations: the paradigm of boundlessness; and what we term “endividualismo”, a novel mutation of individualism in the context of the financial age. The result is a novel political reality where individual rights are ever-expanding and the opportunities for collective action have shrunk to the point of impossibility. The resulting powerlessness of (...) the polity demands new answers: we need to reconfigure the relationship between citizens and political power. (shrink)

En este trabajo se trata de contestar a la cuestión de cómo evaluar los argumentos judiciales de carácter justificativo. Se precisa para ello el sentido de la tesis de la única respuesta correcta; se identifican diversos criterios de corrección y se presta una atención particular a los criterios de universalidad, coherencia, adecuación de las consecuencias, moralidad social y crítica, y razonabilidad. This article deals with the question of how to evaluate justificatory judicial reasoning. To this end, the author clarifies the (...) meaning of the one-right-answer thesis, identifies a variety of criteria of correctness, and gives special attention to the ideas of universality, coherence, (good) consequences, social and critical morality, and reasonability. While Nietzsche's rejection of metaphysical free will and moral desert has been widely recognised, the sense in which Nietzsche continues to use the term freedom affirmatively remains largely unnoticed. The aim of this article is to show that freedom and agency are among Nietzsche’s central concerns, that his much-discussed interest in power in fact originates in a first-person account of freedom, and that his understanding of the phenomenology of freedom informs his theory of agency. He develops a non-reductive drive-psychological motivational (...) theory: reflective judgement and reasons can motivate by means of affective orientations agents have due to their drives. In particular, due to a standing desire or 'instinct for freedom' agents can generate, in mental simulations, the necessary motivational affects to unify their drives in view of certain long-term goals. The article is guided by two main research questions: First, do the Equator Principles (EPs), a voluntary CSR-initiative in the project finance sector, and the recently published working paper of the Thun Group of Banks adequately address the U.N. Guiding Principles on Business and Human Rights or do they fall behind the ‘Ruggie framework’? Second, is the demand for human rights due diligence sufficient to classify the EPs as a positive and leverage-based concept of CSR (à la Wettstein and Wood) (...) or is this requirement still a feature of a negative and impact-based concept of CSR? In case it is a negative and impact-based concept of CSR, the question comes up which further steps should be taken by financial institutions to fulfill their positive and leverage-based responsibilities. The article argues that positive and leverage-based responsibilities for multinational companies exist – due to the moral nature of human rights and due to the political authority of multinational companies – and that the current (Ruggie-like) requirements for human rights due diligence are not adequate for a positive and leverage-based concept of CSR. Further measures should be taken by multinational companies – and especially (Equator) banks which possess a high leverage-influence over their clients – to not only ensure the respect for human rights, but also the on-the-ground protection and realization of human rights. Mereological universalists and nihilists disagree on the conditions for composition. In this paper, we show how this debate is a function of one’s chosen semantics for plural quantifiers. Debating mereologists have failed to appreciate this point because of the complexity of the debate and extraneous theoretical commitments. We eliminate this by framing the debate between universalists and nihilists in a formal model where these two theses about composition are contradictory. The examination of the two theories in the model brings clarity (...) to a debate in which opponents frequently talk past one another. With the two views stated precisely, our investigation reveals the dependence of the mereologists’ ontological commitments on the semantics of plural quantifiers. Though we discuss the debate with respect to a simplified and idealized model, the insights provided will make more complex debates on composition more productive and deflationist criticisms of the debate less substantial. Attention to the details of putatively obvious examples of philosophy-as-worldview within Latin America give us reasons to be skeptical about the taxonomy that gives us the category of philosophy-as-worldview. Among the examples that suggest difficulties for this way of thinking about the philosophical enterprise are 19th century Mexican ethnolinguistics, contemporary efforts to reconstruct historical and contemporary Indigenous thought, and 20th century efforts to articulate regional ontologies within Latin America. However, reflection on these cases also point to a different project worth (...) considering, namely, a taxonomy of wisdom- and knowledge-focused practices that might allow a different way of drawing distinctions between kinds of “philosophies”. Este neorrepublicanismo pretende hacer frente a la profunda crisis de la democracia liberal (corrupción, insolidaridad, apatía ciudadana, etc.), en nuestra época de predominio neoliberal. En el presente artículo desarrollo principalmente su visión de la ética ciudadana; es decir, la importante idea de que la república necesita formular un cierto bien común y promover la virtud cívica de sus ciudadanos, (...) si aspiramos a una sociedad libre de dominación, más justa y solidaria. En la conquista, colonización y evangelización de las Indias se dio una estrecha colaboración y alianza Iglesia-Estado, amalgama que reforzaba a ambas instituciones, aunque siempre bajo el control estatal, supervisada y coordinada por el Consejo de Indias. Las relaciones Iglesia-Estado en América pasaron por diversas modalidades: Patronato, Vicariato y Regalismo. En el siglo XVI rige el Patronato, basado en las concesiones Pontificias que ponía en manos de la Corona española el ‘cuidado’ sobre la Iglesia americana. Desde fines del XVI, religiosos (...) y juristas españoles elaboraron la teoría del Vicariato, según la cual los reyes, en virtud de la donación papal, eran Vicarios de la Santa Sede en las Indias y adquirían competencias en materia de disciplina eclesiástica. En el siglo XVIII el Regalismo asume ambas posiciones y las convierte en jurisdicción civil al considerar que los derechos esenciales del Patronato y el Vicariato no se basan en concesiones papales sino que son prerrogativas inherentes a la Corona, regalías o atributos del poder real. The treatment of a mind theory leads us to considerer some aspects on the mind, the relationship between her operations and the reality that appears as objective. Questions coming from knowledge, as well as human faculties to operate such a connection. This paper deal with an epistemological subject and, at the same time, the way in which the man aspires to the knowledge is analysed, according St. Bonaventure and his thought on the role of the mind to reach the reality. (...) The brief treatise Itinerarium mentis in Deum is a referencial book on this subject. It is useful to stablish a preliminary approach to the first question, and also to carry out a reading the human faculties role on knowledge process. The three first chapters on this book are analysed in order to understand the kind of mind expressed in bonaventurian philosophy. (shrink)
